We’ve all had friends in our circle who were known as “Mary & John”, and when “John” split “Mary” was alone. Mary was the “odd” number at the dinner party and we were all concerned about her. Well, today it seems that the union of Customer & Service have had a breakup. Service has split and Customer is on his/her own.

Today, let me tell you a story that many of you will find humorous but is all too common. I can tell you this without fear of our local editor getting sued because it’s about me, but business owners take note that you don’t fit the profile of company “X”.

Four weeks ago I decided that I needed another green recycling can from my trash pickup company. We’ll call them Brown Keg Trash Pickup, an anonymous company in the interest of avoiding litigation. I called their Customer Service number, and as an environmentally conscious citizen requested my extra recycle can. The cheerful voice on the other end of the line chirped, “Of course, we’ll have one delivered in 48 hours.” After giving her all the pertinent location information, I hung up the phone with the satisfied feeling of a good citizen.

I arrived home about 5 p.m. the next day and I was happy to see another green can at the mouth of my driveway. When I looked again, I noticed that I had another green can - but it was without a lid. I quickly dialed my cheerful telephone voice at Brown Keg Company thanking her graciously for the rapid service and then told her about the missing lid. Just as cheerfully as the first time, she told me to leave it at the end of my driveway after my usual trash pickup and they would replace the entire unit since they didn’t have extra lids. I agreed, and after hanging up the phone I pondered their plight of having lidless cans but no extra lids. I conjured up all sorts of scenarios that explained where all the lids to the lidless cans went, and sympathized with their predicament.

Well, 3 days went by and there sat my poor, green, lidless can at my driveway’s mouth and a replacement never arrived. Feeling empathy for this green plastic waif, I returned it to the side of it’s brother that had a lid. I called my cheerful Customer Service voice again, and reiterated the plight of my poor lidless can and after a chuckle she assured me a complete unit would be forthcoming. I found it necessary to make use of my lidless friend, and put it out the next pickup day filled to the brim. Fortunately, it wasn’t windy and all the contents remained inside it. That was 2 weeks ago, and life being what it is other more important tasks have occupied me until this morning when facing another pickup day I thought of my lidless friend.

Once more I picked up the phone and called my trash pickup company, and this time I listened to a litany of choices of buttons I could punch and chose my cheerful Customer Service button again. I was transferred, listened to a brief melody when there was a “click” and I expected my cheerful voice to chirp “hello”. The next thing I heard was another click, silence, and then the dreaded dial tone that means you’ve been disconnected. Not being one of the “fainthearted”, I simply redialed my number. Again there was the litany of button choices, my choice and the music, and just when I began to feel that all was right with the world I heard - “click”, “dial tone” and nothing.

This was not the morning for the phone to be playing games with me, so I made one more determined effort and REDIALED! “NASA, we have lift-off !” I once more heard the litany of button choices, but this time I outfoxed that monotonous voice and punched “0″. I asked for the Manager of Customer Service, I was given her name and was transferred. What greeted my eager ear was, “You’ve reached the voicemail of ……., please leave your name and number and she’ll return your call.”

So here we sit - my lidless, green can and I facing another pick-up day. This eager-to-serve plastic green waif must bravely face another dutiful day half-clothed.

You must admit that is an amusing story, and one that far too many of us have lived through, but what a sad commentary it is about our business community. Doesn’t it make you wonder if our language has changed so drastically that what we interpret “Customer Service” to mean - is not what today’s business owners mean. It makes me wonder when the marriage of Customer and Service broke-up, leaving us all the lonely ones.

Entrepreneurs and business owners take note! If you’re going to have a number for your customers to access your Customer Service, please follow these rules.

* Have the phone manned by an employee that can hear thunder and see lightening. * Give that employee training in helping the caller and not shuffling the problem to another desk. * Have an overseer, who can also hear thunder and see lightening, check that all incoming complaints were handled appropriately.

After learning how to find your customers and what they want; after getting them committed to doing business with YOU; and after wooing them to keep them as your customers - WHY WOULD YOU LET “SERVICE” DIVORCE “CUSTOMER?”

If your customers aren’t getting the service they require from you - your competitor will be only too happy to help them!

Although there might not be much to save the consumer at this point, there are often special clauses or terms of agreement that can help aid the consumer in once again obtaining their property, as well as coming to a firm agreement with the lender in regards to the defaulted loan.

For the borrower, the auctioning of the house can be a very sad ordeal. But for those who are looking for a home or a good investment property, it is common for foreclosed houses to sell below market value if the loan difference is made up. Otherwise, lenders will commonly declare the auction a loss and try to sell the property via other means. Nevertheless, foreclosed homes are always worth investigating should one be present.

In Conclusion

Going through a foreclosure can be quite depressing, but often times there are loopholes and ways to better the situation should consumers wish it. Others who may be interesting in investing in a real estate property or looking to obtain a home for below market value should investigate public foreclosure auctions where necessary. While the lender may officially decree that the minimum has not been set, often times lenders will take low bids regardless so as to “wash their hands clean” of the matter and get back to everyday business.

In the end, this should be a life lesson for those who go through the foreclosure process- never sign something that one can’t commit to, and always have a backup option just in case.

The REO Market-How to Approach It

REO is short for “Real Estate Owned.” These are properties that have been foreclosed upon by a bank or other lender.

The REO department is staffed by “asset managers.” Their job is to inspect the properties, make the necessary repairs and operate them until they’re sold.

As an independent investor, you can find great opportunities in this area. However, you have to be willing to learn the written and unwritten rules and be prepared to deal with tough-minded REO departments. This article provides you the guidelines for doing just that.

Guideline 1: Understand the Lenders’ Attitudes Toward REO Properties Banks and lenders detest having REO properties on their books. Instead of assets, they have liabilities. Obviously, they want to get rid of these properties; however, they’re not willing to do it at a loss if they can possible prevent that from happening.

Not only do you, as an investor, have to deal with this attitude, but you also have to deal with the fact that banks often don’t like to publicize the fact that they have REOs on their books. They have three reasons for this.

The first reason is that they don’t want federal regulators breathing over their shoulders, questioning their business practices or solvency.

Second, they don’t want their depositors knowing about REOs. Depositors want security above all and if-rightly or wrongly-they see REOs as evidence of questionable practices, they may pull their money out. Banks want to protect their image.

Third, if lenders have a large inventory of REOs, they don’t want the market at large to know about it. If the information leaks out, prices could drop dramatically.

So, how do you find out about REOs? That’s our next topic.

Guideline 2: Present a Professional Image to the REO Department REO asset managers don’t want to deal with amateur investors, so you need to approach them as a knowledgeable professional.

First, call the lender and ask for the REO department. Once in contact, explain that you’re an independent, professional investor and are interested in buying REO properties and would like an appointment with a decision-maker.

Then, use that appointment to present your case and convince the decision-maker that you have the assets and experience of a committed professional. If you do your sales job right, then you can ask for a list of REO properties.

Note: Sometimes, REO departments handle the properties themselves; sometimes, they use a broker. So, you should be prepared to deal with both.

Inspecting REO Properties As you might expect, many of these foreclosed properties aren’t in great condition. The former owners aren’t happy campers so they may not take care of the property or even damage it to vent their anger. So, you’ll definitely need to do due diligence and inspect any properties that you’re considering.

In some cases, lenders will do cosmetic repairs to a property since they know a more attractive home will bring a higher price. To counter this possibility, I recommend that you try to show up as soon as the property is acquired and offer to take it “as-is” to get a lower price.

Buying REO Properties-the Mechanics There’s no great secret to buying these properties. You buy them just as you would any property. First, you make an offer. Then, the lender either accepts it, rejects it, or makes a counter-offer. In the case of a counter-offer, you negotiate.

In terms of payment, most lenders prefer cash because they want to be rid of these properties cleanly and quickly. If this is the case, you’ll need to go to a different lender to get your financing. Just don’t expect a great deal; that lender may want 10% or more down plus closing costs. However, some REO departments realize that they’ll get less from a cash offer so they may offer you financing. The advantage of this is that you may be able to pay a lower down payment, get easier terms, and also obtain some money for improvements. The disadvantage is that you’ll pay more in interest and fees than you would on a strictly-cash basis.

Typical Problems to Expect As I said earlier, many of these properties are in bad condition and may not be worth the money, so inspect them carefully before you commit to a purchase.

Also, as I said earlier, REO properties are sold “as-is.” This means there is no warranty of any kind. Therefore, if you buy a property that later requires very expensive repairs, you’re stuck with that expense. The lesson-perform due diligence!

In the case of federally-chartered lenders, you may not get a disclosure statement (most states require these now). That means there’s the possibility you could get stuck with a property that has severe and expensive problems (e.g., lead paint, etc.).

Finally, if after a home inspection, you find repairs that need to be done, don’t expect the lender to pay for them. Their attitude is, “It’s your problem to solve.”

Key Concept: When approaching an REO department, be a fully-prepared professional.

Why Bear Bile Farming Is Useless

Bear bile farming is a reality today. Although it is unnecessary to bile a bear, it is still very much a common practice in some places today. It causes extreme pain to the bears. During the process, it can be observed that bears gnash their teeth, bite their cages, moan, and even chew their own paws because of the pain.

Bile Extraction - Bile extraction is done in the crudest manner, and without any form of sanitation. The persons conducting it are unskilled and the process is not up to modern veterinary standards. Most of the bears die during or soon after bile extraction. If they live, they suffer from liver cancer, as a result of chronic inflammation and infection of the gall bladder and liver. Generally, farmed bears live only up to 4 years.

Why People Bile Bears - Bile is a digestive liquid produced by the liver and stored in the gall bladder. Bile gathered from bears has been used in traditional Chinese medicine for at least three thousand years for a variety of purposes. It is used in Chinese physiotherapy, to cure inflammations and to dissolve gall stones and kidney stones. Also, it is thought to help detoxify the liver and improve eyesight. And according to research, bears are the only mammals that produce the bile salt ursodeoxycholic acid, which is effective in treating some liver diseases.

Before, bear bile was gathered by killing wild bears and removing their gallbladders. In recent decades, when wild bears became increasingly rare, bile became prohibitively costly for most Chinese. But then, during the year 1980, the Chinese bear bile farming industry adapted a technique first developed in North Korea. This involved extracting bile from captive bears without having to kill them.

Bear Cruelty - The bears are housed in cages hardly large enough to hold the animal itself. To get the bile, an incision is made in each bear’s abdomen and a catheter (which is basically a plastic or rubber tube) is then inserted into the gallbladder. The bile is drained through the catheter and then gathered for sale.

How is the process done? To gather the bile from the gallbladder, a connection from the gallbladder (located deep inside the body) to the surface has to be established. The connection, which is medically called fistula, is made in any of the three ways: insertion of a metal tube, insertion of a plastic tube, or creation of a tissue bridge between the gallbladder and skin. The connection is conducted by untrained and unskilled individuals who do not observe modern veterinary standards.

To gather the bile, some bears wear a “metal jacket”. It is worn around their bodies and it has a collection container attached to it. There are bears forced to lie on the floor of their small cages so the bile will drip downward. Keep in mind that their crush cages are extremely small. The floor is made up of iron bars so the bears cannot stand or lie down on firm ground. This results in neck and back injury. Since a bear’s body will try to exclude the inserted metal or plastic tube or close the tissue bridge, scarring and damage is done to both the inside and outside of the bear. Sometimes, to prevent the closing of the incision, hot pieces of metal are inserted without any form of sedation or anesthesia. Bile is collected twice a day, and this goes on for the rest of their lives.

Why Bear Farming is Useless - This is all very unnecessary. There is no need to make poor bears undergo such abuse. The use of bear bile is obsolete. There are at least 75 herbal medicines that can be used as an alternative to bear bile. Of which, 54 are proven to work. These alternatives are a lot cheaper and more convenient.

Now, synthesized bear bile that contains UrsoDeoxyCholic Acid (the active constituent in bear bile) is available. All these alternatives are just as effective without the deaths of innocent bears. Let us put a stop to bear bile farming. It causes unnecessary torture to poor bears.
